The Peoples’ Permanent Tribunal* which has been investigating the social and environmental impacts of companies in Colombia, has recently heard evidence against a number of companies, including two that are certified by the FSC: Smurfit Kapa Cartón de Colombia and Pizano SA. (Smurfit was certified for FSC by SGS Qualifor; in contravention of FSC’s requirements, there was no information about this certificate available on SGS’s website at the date of this posting. Pizano was certified by SmartWood.)

The ‘verdict’ of the Tribunal’s meeting in Colombia’s Low Atrato region on 26-27 February 2007 included the following conclusions:

“The company Smurfit Kapa Cartón de Colombia was accused of the violation of human, environmental, social and cultural rights. More specifically, of destroying tropical rainforests, Andean forests and other ecosystems and of destroying the social network, the traditional and cultural forms of production of communities; for depleting and polluting water sources; for influencing the elaboration of government policies in the country and for putting pressure on government officials to favour the company’s interests and manipulating the media at both the regional and national level; for spreading false statements, information and publicity to justify its activities and for hiding the resulting impacts; for accusing and criminalizing with false arguments those who denounce its improper conduct.”

“The company PIZANO S.A and its subsidiary MADERAS DEL DARIÉN were accused of the destructive mechanized extraction of the natural resources of the Cacarica river basin; of having generated a profound damage on the territory, the forest resources and the living conditions of the Afrocolombian communities that live in the logging areas; of having benefited from extensive logging impacting mainly on the forests of the Riosucio and Carmen del Darién municipalities in the Chocó department; of the indiscriminate exploitation of the “catival” species (Priora copaifera), which is listed as a species in extinction, and the generation of serious impacts on the humid tropical forests, as well as the forced displacement of more than 2,500 Afrocolombians and racially mixed populations as well as a third of the region’s indigenous peoples following Operation Genesis, during which the collusion between the army and paramilitaries was evident and where the population was attacked with machine guns, their possessions and crops were burnt, extrajudicial executions, sexual violence, forced disappearances and other serious human rights violations were carried out.”

The PPT was set up by the Rome-based Lelio Basso International Foundation for the Rights and Liberation of Peoples.

A la empresa Smurfit Kapa – Cartón de Colombia, se le acusó por violación de derechos humanos, ambientales, sociales y culturales. Específicamente por: destrucción de selvas húmedas tropicales, bosques andinos y otros ecosistemas y por destruir el tejido social, medios de producción tradicional y cultural de las comunidades; suprimir y contaminar fuente hídricas; influir la formulación de políticas gubernamentales en el país y presionar a funcionarios del Estado en pro de los intereses de la multinacional; ocultar información relacionada con la empresa y manipular los medios de comunicación tanto a escala regional como nacional; usar falsos postulados, información y publicidad mentirosa para justificar sus actividades y enmascarar los impactos generados; acusar y criminalizar con argumentos falsos a quienes denuncian su accionar incorrecto.

A la empresa PIZANO S.A Y SU FILIAL MADERAS DEL DARIÉN, se le acusa del uso destructivo en forma mecanizada de los recursos maderables del Cacarica; haber generado un profundo daño en el territorio , los recursos forestales y en las condiciones de vida de las comunidades afrocolombianos que habitan las zonas de extracción; beneficiarse de la explotación extensiva de madera, afectando principalmente las formaciones boscosas de los municipios de Riosucio y Carmen del Darién en el departamento del Chocó; la explotación indiscriminada de la especie catival ( Priora copaifera ), que se cataloga como una especie en vía de extinción, y la generación de un agudo impacto sobre la vocación forestal de la selva húmeda tropical, así como del desplazamiento forzoso de más de 2.500 afrocolombianos y mestizos y una tercera parte de los pueblos indígenas de la región luego de la Operación Génesis en la que fue evidente la connivencia con los paramilitares de las Autodefensas Campesinas de Córdoba y Urabá (hoy Bloque Elmer Cárdenas) en la que se perpetraron ametrallamientos contra la población, incendios a sus bienes y cosechas, ejecuciones extrajudiciales, violencia sexual, desapariciones forzadas y otras graves violaciones a los derechos humanos. Al Estado Colombiano se le atribuyó responsabilidad por su acción y omisión en los crímenes de lesa humanidad, genocidio y terrorismo, en todas las manifestaciones que se anotaron cometidos por miembros de la Brigada XVII del Ejército Nacional en colaboración con los grupos paramilitares que se encuentran en la zona así como por mantener en la impunidad cada uno de los delitos cometidos contra las víctimas y por no investigar, juzgar y sancionar en debida forma, a los miembros de la fuerza pública y a los paramilitares que actúan en connivencia.
